Feds Ask Court To Drop Casino Suit - 2004-01-30
The U.S. Attorney's office is asking for the dismissal
of the Kansas attorney general's complaint against the Wyandotte casino in downtown Kansas City, Kan. According to the federal prosecutor's motion, filed Monday in U.S. District Court in Topeka, Kan., the court has no authority over the case.
"This court lacks jurisdiction over plaintiff's claims ... as plaintiff has failed to join an indispensable party, the Wyandotte Tribe of Oklahoma, which is immune from suit," part of the motion stated. It was filed by Eric Melgren, U.S. attorney in Kansas.
